Unless the suit is patently baseless, judges usually want to err towards giving the claimant the opportunity to make its case and to give the parties more time to negotiate a settlement.

For a Motion to dismiss to be successful the claims in the Complaint, even if all were true, do not amount to a cause of action.  What the judge is saying to the ACC is that FSU gets to make their argument in the lawsuit.  Not that the ACC is wrong.

The math already showed that they end up with more money directly related to ACC contracts than they got with a full share in the aac, but ya people would give much more to an ACC usf athletics program than they would to the aac bulls

I kind of got turned on by all the board’s baseball fans coming out on the new head baseball coach thread; but when we bring out the lawyers and the lawyering it’s equally stimulating.

They were all lined up ...... but then the deal to trade campuses with UTEP fell through.
